's the nation's largest credit rating agency. the agency played a huge role in the 2008 financial crisis. diane macedo from the fox business network has the details. >>> the justice department is suing s&p saying the high ratings to mortgage bonds that tanked in value and fuelled the 2008 financial crisis. from september 2004 to october 2007 s&p knowingly defrauded investors in hopes of decreasing revenue and market share. the ratings firm suggest it is being unfairly punished to predict a housing maelt down no one else predicted either. it was without factual or legal mir rit. sources tell the wall street journal for 4 months both sides discussed a potsible settlement with the case. a deal could leave it more vulnerable to other lawsuits. while this is the first government suit of its kind many investors say they were misled by ratings and dozens of the cases have been thrown out on the grounds that the ratings are opinions protected by the government. government is expected to take a legal approach. it will be interesting to see how this one plays out. >> diane macedo from fox business. thank

african sprinter featuring a phrase, i am the bullet in the chamber. unfortunate. diane macedo is here. >> nike and oakley announced they suspended their sponsorship contracts with oscar pistorius what may seem like a bit of deja vu. few months ago the same two companies severed ties with lance armstrong amid his massive doping scandal. with pistorius facing murder charges against his girlfriend. that can get very tricky. matt mcdonald of jwt new york told me timing is key. consumers don't confuse actions of celebrity in trouble with the actions of the brand unless the brand drags its feet. brand don't want to preemptively indict celebrities. nike said yesterday, we believe oscar pistorius should be afforded due process and we'll continue to monitor the situation closely. keep in mind brand don't always part ways with celebrities in trouble. nike stood by tiger woods after his massive scandal and resigned with michael vick after his doug fighting trouble. the key is that the brand has to folk not on perfection but being truthful and human. that of course is subjective. it will be inter

impact? and is this market in denial as it continues to hang strong? good morning to you, diane. >> good morning. >> we're within striking distance here of all-time highs potentially on the cost of a gallon of gas. how do you explain that to people at this time of year? because this is very early to have thirt o rally. >> it is very early to have the rally. and it's a multitude of factors, in addition to, we've seen crude prices go up on brent, which is part of the problem, because that's in the mix, about 68% of the price at the pump is the actual cost of oil. wti and cushing hasn't gone up as much. it gets stuck down in cushing, oklahoma, so we don't get it all in the places we need. frankly, it doesn't really matter, at the end of the day, we're now talking about a rise in the price of gasoline 25 cents in the first two weeks of february alone. a rise in the price of gasoline that is equivalent to the payroll tax holiday expiring for some households, depending how much they fill up their tank a month. it could be up to $20 a week extra they're paying at this stage of the game. as you
